Always Wait for Law Enforcement Before Leaving An Accident Scene
Two of my recent clients were involved in minor accidents – minor as far as damage to the vehicles. They were able to drive their cars from the accident scene.
Here’s the problem. After exchanging information with the opposing driver, everyone left the scene before law enforcement arrived. Consequently, no accident report was prepared. How could it be prepared? The vehicles were gone and the drivers, whom the officer would have interviewed, were gone. No information for an accident report.
Personal injury attorneys rely extensively on accident reports to establish the fault (liability) of opposing drivers. Often the at-fault driver is issued a ticket. I love it when I look at an accident report and see that a ticket was issued to the opposing driver. If everyone leaves the scene, there is no basis for a ticket either.
Always call law enforcement and wait for law enforcement at a traffic accident scene. It could mean thousands of dollars to you.
